Comments

1. About These Terms

These terms and conditions (“Terms”) govern the purchase of products through dinakamal.com (the “Site”), operated by DINAKAMAL DK01 LONDON LIMITED, company number 11040391, whose registered office is at 1 Vincent Square, London, SW1P 2PN.

By placing an order through the Site, you agree to be bound by these Terms, together with our Shipping & Returns Policy and Privacy Policy.

If you are a consumer, nothing in these Terms affects your statutory rights.

2. Our Products

DINAKAMAL is a London-based design practice creating fine jewellery and objects.

Our jewellery is made in 18k gold and is offered in a range of finishes, including beige, black, pink and yellow gold, with availability varying by piece.

Where diamonds are used, DINAKAMAL uses natural diamonds only and does not work with lab-grown diamonds.

Each piece is individually handmade. As a result, subtle variations in finish, texture, weight and form may occur between individual pieces. These variations are a natural characteristic of handcrafted jewellery and are not considered defects.

3. Product Descriptions & Accuracy

We make every reasonable effort to ensure that product descriptions, dimensions, weights, colours and photographs on the Site are accurate and up to date.

However, photographs may appear differently depending on the device or screen used to view them. Because each piece is individually handmade, the exact appearance, finish, dimensions, weight and other characteristics of a product may vary slightly from the information shown on the Site.

Any stated gold weights, diamond carat weights, dimensions and other measurements are therefore approximate unless expressly stated otherwise.

These variations do not affect your statutory rights where a product does not conform to the contract.

4. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to place an order through the Site.

By placing an order, you confirm that the information you provide to us is accurate and complete.

5. Prices & Payment

All prices displayed on the Site are in Pounds Sterling (GBP) and, unless otherwise stated, include UK VAT.

For customers outside the UK, the treatment of VAT, customs duties, import taxes and other charges will depend on the destination country and applicable shipping arrangements. Further information is provided in our Shipping & Returns Policy.

For eligible customers in the US, UK VAT may be removed or refunded in accordance with our applicable VAT and export procedures. Customers should contact us at info@dinakamal.com for further information.

We accept payment by Visa, Mastercard, American Express, Apple Pay and Google Pay through our payment processor, Stripe. Bank transfer may also be available on request; please contact info@dinakamal.com for details.

Payment is taken in full at the time of order unless otherwise agreed in writing.

Your order will be confirmed once payment has been successfully processed and we have sent you an order confirmation email.

6. Order Acceptance

When you place an order through the Site, you are making an offer to purchase the product or products in your order.

Your order is not accepted until we send you an order confirmation email. We reserve the right to decline or cancel an order before acceptance, including where:

• a product is unavailable;
• there is an error in the price or description of a product;
• we reasonably suspect fraudulent or unauthorised activity;
• we are unable to fulfil the order; or
• we are unable to deliver to the requested destination.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order using the original payment method, unless otherwise agreed.

7. Made-to-Order, Bespoke & Personalised Products

Certain DINAKAMAL products may be made to order, produced to a specific ring size, altered at your request, or otherwise personalised or made to your specification.

Where a product is made specifically to your requirements or is personalised, it may not be eligible for cancellation or return under the statutory change-of-mind cancellation rights that apply to standard online purchases.

Any applicable exclusions will be clearly communicated to you before you place your order and will also be set out in our Shipping & Returns Policy.

Nothing in this section affects your statutory rights in relation to products that are faulty, not as described or otherwise do not conform to the contract.

8. Ownership & Risk

Ownership of a product passes to you once we have received payment in full for that product.

If you are a consumer, risk in the product remains with DINAKAMAL until the product comes into your physical possession, or the physical possession of a person you have identified to receive it on your behalf, unless applicable law provides otherwise.

If you specifically arrange for a carrier to collect the product from us that we did not offer as a delivery option, risk may pass to you when the product is handed to that carrier.

9. Manufacturing Warranty

All DINAKAMAL jewellery purchased directly from us is covered by a 12-month warranty against manufacturing defects from the date of purchase.

Where a product develops a manufacturing defect within this period, we will assess the piece and, where the issue is determined to be a manufacturing defect, repair the piece free of charge. If repair is not reasonably possible, we may offer a replacement or another appropriate remedy.

The warranty does not cover:

• normal wear and tear;
• scratches, dents or surface damage resulting from use;
• accidental damage;
• loss or theft;
• damage caused by misuse, improper care or storage;
• damage caused by exposure to chemicals, heat or other substances;
• damage caused by a third party or by work carried out by another jeweller without our prior written approval; or
• alterations or modifications not carried out or approved by DINAKAMAL.

Where a piece is returned to us under warranty, we may require the item to be inspected before determining whether the issue is covered.

This warranty is in addition to, and does not limit, your statutory rights as a consumer.

10. Repairs & Aftercare

We may be able to offer repair, resizing, restoration or other aftercare services outside the warranty period.

Any such work may be subject to inspection and quotation before work begins.

Where a repair or alteration is carried out by DINAKAMAL, we will advise you of any applicable cost and estimated timeframe before proceeding.

Repairs or alterations carried out by another jeweller without our prior written approval may affect your warranty.

11. Intellectual Property

All content on the Site, including text, photographs, images, graphics, designs, logos, product names and other materials, is owned by DINAKAMAL or its licensors and is protected by applicable copyright, trademark, design and other intellectual property laws.

You may access and use the Site and its content for your own personal, non-commercial purposes.

You must not reproduce, modify, distribute, publish, sell, licence or commercially exploit any Site content without our prior written consent.

12. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for:

• death or personal injury caused by our negligence;
• fraud or fraudulent misrepresentation; or
• any other liability that cannot legally be excluded or limited.

If you are a consumer, nothing in these Terms limits or excludes your statutory rights or our liability for failing to comply with the legal requirements applicable to the sale of goods.

Subject to the above, and to the fullest extent permitted by law, DINAKAMAL will not be liable for indirect or consequential loss that was not reasonably foreseeable at the time the contract was formed.

Nothing in these Terms affects your statutory remedies where a product is faulty, not as described, not fit for purpose or otherwise does not conform to the contract.

13. Privacy

Our Privacy Policy explains how we collect, use and protect your personal information, including information provided when placing an order.

We may share relevant information with service providers, including our payment processor, Stripe, where necessary to process and fulfil your order.

14. Governing Law & Jurisdiction

These Terms and any contract between you and DINAKAMAL are governed by the laws of England and Wales.

If you are a consumer, you will also benefit from any mandatory protections provided by the laws of the country in which you live that cannot lawfully be excluded.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law gives you the right to bring proceedings in another jurisdiction.

Nothing in our complaints process affects your statutory rights.

16. General Provisions

If we delay or fail to exercise any right or remedy under these Terms, this will not constitute a waiver of that right or remedy.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations under these Terms to another organisation in connection with a merger, restructuring, sale or transfer of all or part of our business, provided that this does not adversely affect your rights under these Terms.

These Terms, together with the Shipping & Returns Policy and Privacy Policy, form the agreement between you and DINAKAMAL in relation to your purchase, subject to any rights and protections that apply to you under consumer law.

We may update these Terms from time to time, for example to reflect changes to our products, services, shipping arrangements or applicable law.

The version of these Terms that applies to your order will be the version in force at the time your order is accepted.
